Terms of Service

These Terms of Service ("Terms") govern your use of Kamado ("the bot", "we", "us"). By adding Kamado to a Discord server or using any of its commands, you agree to these Terms. If you do not agree, do not use the bot.

1. Definitions and References

The following names all refer to the bot and/or its staff, and are used interchangeably throughout these Terms and any related communications:

2. Eligibility

You must meet the minimum age requirement set by Discord in your country and comply with Discord's Terms of Service at all times. By using Kamado, you represent that you meet these requirements.

4. Prohibition on Storing Sensitive Information

Bot features such as reminder content, AFK messages, profile bios, to-do items, moderation reasons, reputation notes, and shop item descriptions are intended for general Discord use only. You must not store sensitive personal information in any of these fields. This includes, but is not limited to: passwords, financial information, government-issued ID numbers, medical information, or any other data that could cause harm if exposed.

If a user is found to have stored sensitive information in a bot field:

  1. They will be notified and given a reasonable opportunity to remove it themselves. Bot staff will not remove it on their behalf.
  2. If they fail to remove it, they will be permanently blacklisted from using Kamado.
  3. Upon blacklisting for this reason, the following data will be deleted:

    • Reminders, AFK status, birthdays, to-do items, trivia stats, Impostors game stats, profile bio, user settings, shop inventory, and economy cooldown records.
    The following data will be retained:

    • XP and leveling progress, reputation score, and reputation transaction history.
    • Virtual economy coin balances (server and global), which may be reviewed as part of any abuse investigation.
    • Premium subscription records and any associated billing or entitlement logs.
    • All warnings, moderation cases, and server or audit logs — in full, regardless of whether the user appears as a subject.
    • The blacklist entry itself.

    These lists are not exhaustive. Any deletion request submitted after a blacklist may be partially or fully rejected if the data in question cannot be cleanly removed without affecting other users' records, server data, or the integrity of our enforcement history.

5. Virtual Economy and Server Shop

Kamado includes a virtual economy system ("Economy") comprising server-specific coin balances, a global coin balance earned through bot-wide activities, and a server shop where administrators can list items for purchase with those coins.

No Real-World Value

Virtual coins and shop items have no monetary value and cannot be exchanged for real currency, goods, or services outside of Kamado. Any coins or items you accumulate exist solely within the bot's systems and confer no rights beyond in-bot use.

Economy Integrity

You agree not to use bugs, automation, self-botting, coordinated coin farming, or any other method to acquire virtual coins or items outside of normal gameplay. We reserve the right to correct, reset, freeze, or remove any balances or inventory acquired through abuse, exploitation, or violation of these Terms, without notice or compensation.

Server Shop

Shop items are configured and managed entirely by server administrators. We are not responsible for the content, accuracy, availability, or perceived value of items listed in any server's shop. Server administrators are solely responsible for the items they create, the roles or perks they attach, and ensuring those items comply with Discord's guidelines and applicable law.

Economy Suspension

If a user is blacklisted, their virtual coin balances and shop inventory may be reviewed and reset at our discretion. Virtual currency and shop items are not subject to any refund or compensation claim in connection with enforcement actions.

No Guarantees

We do not guarantee the continued availability of the Economy system or any specific shop item. Economy features, reward amounts, and shop functionality may be changed, removed, or reset at any time.

By adding Kamado to a server, the server administrator agrees to:

7. Data Collection and Deletion

By using Kamado, you acknowledge that certain data is collected and stored to provide the bot's features, including economy balances, command cooldowns, and shop inventory. Refer to the Privacy Policy for full details on what is collected, how it is used, and how to request deletion.

Deletion requests — whether from individual users or server administrators — may be partially or fully rejected if the data in question cannot be cleanly removed without affecting other users' records, server data, enforcement history, or legally required retention obligations. Submitting a deletion request does not guarantee full or immediate deletion.

8. Premium Subscriptions

Kamado may offer paid subscription tiers that unlock access to additional features. When purchasing a subscription:

9. Subscriptions and Enforcement

Rule Compliance

A paid Premium subscription does not grant any immunity from these Terms. All users, regardless of subscription tier or status, are subject to the same rules, including the prohibition on storing sensitive information (Section 4), the Economy integrity requirements (Section 5), and all other acceptable use requirements. Premium features are a privilege, not a shield against enforcement.

Termination of Access

If a user or server is blacklisted for a violation of these Terms, access to all bot features, including any active paid Premium features and any virtual economy balances, is terminated immediately and without notice. No grace period is provided.

Refund Policy for ToS Violations

If a user is permanently blacklisted due to a Terms of Service violation, the remainder of their current subscription period is forfeited. Refunds for the current billing cycle are not guaranteed and are issued solely at the discretion of the bot owner, subject to applicable payment platform policies. Accepting a refund does not reverse the blacklist.

Chargebacks and Payment Disputes

Initiating a chargeback or payment dispute in bad faith following a blacklist or after receiving services is considered a violation of these Terms. We reserve the right to contest any such dispute and to take further action, including permanent blacklisting of any associated accounts.

Appeals

Blacklisted users who believe their blacklist was issued in error may appeal by contacting us at painsjonas@gmail.com. Submitting an appeal does not pause or restore access during review. If an appeal is successful and the blacklist is overturned, any remaining subscription period will not be automatically reinstated — users whose appeals are successful may re-subscribe at the current rate. Virtual economy balances that were reset as part of enforcement will not be restored upon a successful appeal.

10. Availability and Changes

Kamado is provided as-is. We do not guarantee any level of uptime or uninterrupted availability. Features may be changed, added, or removed at any time. We will make reasonable efforts to communicate significant changes in advance, but are not obligated to do so.

Public Domain Content

Kamado may incorporate or reference content that is in the public domain. If you believe any content used by Kamado infringes on your rights or you would like it removed, please contact us at painsjonas@gmail.com and we will promptly review and take it down upon request.

11. Intellectual Property

All code, branding, and content associated with Kamado remain the property of its developers. You are granted a limited, non-exclusive right to use the bot's features. You may not copy, redistribute, or create derivative works based on Kamado without explicit permission.

12. Termination and Suspension

We reserve the right to restrict, suspend, or permanently blacklist any user or server from using Kamado at our discretion, with or without notice, particularly in cases of abuse, violations of these Terms, or behavior harmful to other users.

Termination of Service

We reserve the right to discontinue, shut down, or terminate Kamado and all related services, data, and infrastructure at any time, with or without notice. Upon termination, all stored data may be permanently deleted. We are not liable for any loss resulting from such termination, including but not limited to loss of XP, premium subscription access, moderation records, or any other data associated with your account or server.

13. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use Kamado, including but not limited to data loss, moderation errors, service interruptions, or loss of virtual economy balances. For paid subscription features, our total liability for any claim is limited to the amount you paid in the 30 days prior to the event giving rise to the claim. Virtual coins and shop items carry no monetary liability under any circumstances.

14. Changes to These Terms

We may update these Terms at any time. When we do, the "Last updated" date at the top will be revised. Continued use of Kamado after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of Kamado that cannot be resolved informally shall be submitted to the appropriate courts located in New Jersey.

16. Dispute Resolution

Before initiating any formal legal action, you agree to first contact us at painsjonas@gmail.com and attempt to resolve the dispute in good faith. The 30-day informal resolution period begins from the date of written notice. If the dispute cannot be resolved informally within that period, either party may pursue resolution through small claims court in New Jersey, provided the claim qualifies under applicable jurisdictional limits.
